By accessing or using 701arms.com (the “Website”), placing an order, requesting a quote, or purchasing any product or service from 701 Arms LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms & Conditions. If you do not agree, do not use this Website or purchase our products.
1. Eligibility
You must be at least:
- 18 years old to purchase long guns and rifle/shotgun ammunition
- 21 years old to purchase handguns or handgun ammunition
By placing an order, you confirm that you are legally eligible to purchase, possess, and receive the items ordered under all applicable federal, state, and local laws.
2. Legal Compliance
It is the sole responsibility of the customer to ensure compliance with all federal, state, and local laws regarding the purchase, possession, transfer, transportation, and use of any product sold by 701 Arms.
We do not provide legal advice. Orders may be refused, canceled, or refunded if legal compliance cannot be verified.
3. Firearms Purchases & FFL Transfers
- Firearms must be shipped to a valid Federal Firearms Licensee (FFL).
- The buyer must be the actual transferee/buyer.
- A completed ATF Form 4473 and background check are required at the receiving FFL.
- Firearms will not ship without a valid copy of the receiving FFL’s license.
- If the selected FFL refuses, delays, or cannot accept the transfer, the buyer is responsible for all related fees, shipping, and restocking costs.
Once a firearm has been transferred, all sales are final.
4. Orders, Pricing & Payment
- All prices are listed in U.S. dollars.
- Pricing is subject to change due to manufacturer or distributor cost fluctuations.
- Payment must be received in full before orders are processed.
- We reserve the right to cancel or refuse any order for any reason, including suspected fraud or inventory issues.
5. Special Orders
Special orders are subject to availability and distributor approval.
Special orders are non-refundable once placed, unless otherwise required by law.
6. Product Descriptions & Errors
Product images, descriptions, and specifications are provided by manufacturers or distributors and may contain errors.
We only guarantee delivery of the product matching the listed UPC or model number.
701 Arms is not responsible for typographical errors, image inaccuracies, or manufacturer changes.
7. Shipping & Risk of Loss
- Many items ship directly from distributors.
- Shipping times are estimates and not guaranteed.
- Risk of loss passes to the customer upon transfer to the carrier.
- We are not responsible for carrier delays, loss, theft, or damage after delivery confirmation.
8. Returns, Refunds & Restocking Fees
- All firearm sales are final.
- Ammunition and certain regulated items are final sale unless required by law.
- Any return must be approved by 701 Arms LLC
- Approved returns may be subject to:
- Original shipping costs
- Return shipping costs
- $50 and/ or up to a 20% restocking fee
No refunds will be issued until returned items are received and inspected.
9. Background Check Denials & Failure to Transfer
If a firearm transfer is denied, delayed beyond a reasonable timeframe, or not completed:
- The buyer is responsible for return shipping and restocking fees
- No refund will include shipping or transfer fees
10. Chargebacks, Payment Disputes & Fraud
By placing an order with 701 Arms LLC, you expressly agree that you will not initiate a chargeback, payment dispute, or reversal with your bank, credit card issuer, or payment provider without first contacting us and providing a reasonable opportunity to resolve the issue.
Unauthorized or Improper Chargebacks
An unauthorized, improper, or bad-faith chargeback includes, but is not limited to:
- Filing a chargeback for a lawfully completed or shipped order
- Filing a chargeback after a firearm or item has been transferred to an FFL
- Filing a chargeback due to buyer’s remorse, background check denial, or legal ineligibility
- Filing a chargeback for delays outside of our control (manufacturer, distributor, carrier, or FFL delays)
- Filing a chargeback after agreeing to our Terms & Conditions, Return Policy, or Special Order terms
Consequences of Chargeback Abuse
If a chargeback is initiated in violation of these Terms, 701 Arms LLC reserves the right to:
- Immediately cancel any pending or future orders
- Permanently suspend or terminate the customer’s account
- Refuse future service at our sole discretion
- Recover all costs associated with the chargeback, including but not limited to:
- Chargeback penalties imposed by payment processors
- Administrative and processing fees
- Shipping and handling costs
- Distributor or manufacturer restocking fees
- Legal fees and collection costs where permitted by law
Higher-Dollar & Firearms Transactions
For high-value transactions, firearms, special orders, or custom items, the customer acknowledges that chargebacks may cause significant financial harm to 701 Arms LLC. In such cases, we reserve the right to pursue recovery of the full transaction amount, associated fees, and damages through collections, civil remedies, or legal action, as permitted by law.
Fraud Prevention & Evidence Submission
We may submit all relevant documentation to financial institutions and payment processors in response to chargebacks, including:
- Order confirmations
- Shipping records and carrier confirmations
- FFL documentation
- IP address and transaction data
- Communications with the customer
Fraudulent Activity
Any suspected fraudulent activity may be reported to:
Federal authorities where applicable
Payment processors
Financial institutions
Law enforcement
11. Assumption of Risk
Firearms, ammunition, and related products are inherently dangerous.
By purchasing from 701 Arms, you voluntarily assume all risks associated with the use, handling, storage, transportation, and operation of these products.
12. Limitation of Liability
To the fullest extent permitted by law, 701 Arms LLC shall not be liable for any:
- Direct or indirect damages
- Personal injury or property damage
- Product misuse or improper handling
- Manufacturer defects
- Delays or third-party failures
Our total liability shall not exceed the purchase price of the product in question.
13. Indemnification
You agree to defend, indemnify, and hold harmless 701 Arms LLC, its owners, employees, affiliates, and partners from any claims, damages, losses, or expenses arising from:
- Your purchase or use of products
- Violation of these Terms
- Violation of any applicable laws
14. Manufacturer Warranties
All warranties, if any, are provided by the manufacturer.
701 Arms does not offer independent warranties and is not responsible for manufacturer warranty decisions.
15. Intellectual Property
All Website content, logos, text, images, and designs are the exclusive property of 701 Arms LLC and may not be used without written permission.
16. Account & Order Termination
We reserve the right to suspend accounts, refuse service, or cancel orders at our sole discretion, including for policy violations or abuse.
17. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of North Dakota, without regard to conflict-of-law principles.
18. Dispute Resolution
Any dispute arising from these Terms or purchases shall be resolved through binding arbitration or court proceedings in North Dakota, and you waive the right to jury trial or class actions where permitted by law.
19. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
20. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of the Website constitutes acceptance of any changes.
